Pregnancy Justice’s one-of-a-kind study identifies hundreds of criminal and civil cases involving the arrests, detentions and equivalent deprivations of pregnant women’s physical liberty that occurred between 1973 and 2005, after the decision in Roe v. Wade was issued.

On January 15, 2013, the Journal of Health Politics, Policy and Law published a study, "Arrests of and Forced Interventions on Pregnant Women in the United States, 1973-2005: Implications for Women's Legal Status and Public Health," written by Lynn M. Paltrow, Pregnancy Justice Executive Director, and Jeanne Flavin, Professor of Sociology at Fordham University and Pregnancy Justice Board President.

Abstract: All pregnant women, not just those who seek to end a pregnancy, have benefited from Roe v Wade. Today’s system of mass incarceration makes it likely that if Roe is overturned women who have abortions will go to jail.

Pregnancy Justice’s Lynn Paltrow on Alabama Supreme Court’s Decision in “Personhood” Measure in Disguise Case

New York, NY – In response to the Alabama Supreme Court’s decision in Ex Parte Ankrom and Kimbrough yesterday, Pregnancy Justice released the following statement from founder and executive director Lynn Paltrow:

“This decision is judicial activism at its most dangerous.

We are still celebrating the fact that Mississippians soundly rejected the so-called “personhood” measure that would have given fertilized eggs, embryos, and fetuses separate legal rights. We know that when people understand that fetal separatist measures hurt all pregnant women, they mobilize.

Yesterday, Mississippians rejected (58-42) Proposition 26 that would have recognized fertilized eggs, embryos, and fetuses as separate legal persons under Mississippi law. Put another way, yesterday, 58% of Mississippians supported and reaffirmed the constitutional personhood of pregnant women.
